Mpepu Nnaka Day Care — Terms and Conditions

These Terms and Conditions govern the use of Mpepu Nnaka Day Care’s services and the use of the KidKonekt daycare management platform by parents and guardians.
By registering your child at Mpepu Nnaka Day Care, you confirm that you have read, understood, and agreed to these Terms and Conditions.
1. Registration and Enrolment

Parents or legal guardians must provide accurate and complete information when registering a child.

Parents/guardians are responsible for ensuring that all information provided to the daycare remains current and accurate.

Mpepu Nnaka Day Care reserves the right to request supporting documentation where reasonably necessary, including identification documents, proof of address, emergency contact information, and relevant medical information.

The daycare may refuse or suspend enrolment where required information has not been provided or where the daycare is unable to safely accommodate the child.
2. Parent and Guardian Responsibilities
Parents and guardians agree to:

Provide accurate contact and emergency information.

Inform the daycare of any relevant medical, allergy, dietary, behavioural, or other information that may affect the child’s health, safety, or wellbeing.

Notify the daycare of changes to authorised pickup persons.
-
Ensure that only authorised persons collect the child.
-
Comply with the daycare’s operating hours, policies, procedures, and safety requirements.

Ensure that school fees and other agreed charges are paid on time.
-
Treat daycare staff, other parents, guardians, and children respectfully.
3. Attendance and Drop-Off/Pickup

Children must be dropped off and collected within the daycare’s designated operating hours.

Parents/guardians must follow the daycare’s registration and attendance procedures.

Mpepu Nnaka Day Care may use KidKonekt’s attendance and pickup verification features to record attendance and help verify authorised collection of children.

Parents/guardians must immediately notify the daycare if an authorised pickup person changes.

The daycare may request identification or other verification before releasing a child.
-
A child will not ordinarily be released to an unauthorised person unless the daycare has received appropriate prior authorisation from the parent or legal guardian.
4. Fees and Payments

Parents/guardians are responsible for paying all applicable registration fees, school/daycare fees, additional service charges, and other agreed amounts.

Fees are payable according to the payment schedule communicated by Mpepu Nnaka Day Care.

Invoices may be issued through the KidKonekt platform.
-
Payments may be processed through authorised payment providers, including PayFast where applicable.
-
Parents/guardians should retain payment confirmations for their records.
-
Late or outstanding payments may result in the suspension of services, subject to applicable law and the daycare’s payment policy.

Any applicable discounts, refunds, credits, or payment arrangements must be agreed with Mpepu Nnaka Day Care in writing.
5. KidKonekt Platform
Mpepu Nnaka Day Care uses KidKonekt as its daycare management platform.
Through KidKonekt, parents/guardians may have access to features such as:

Child registration and profile information;

Attendance records;
-
Pickup/drop-off verification;
-
Invoices and payment information;
-
Parent/daycare communication;
-
Notifications and announcements;
-
Photos and media shared by the daycare;
-
Reports and other administrative information.
Use of the KidKonekt platform is subject to these Terms and Conditions and any applicable KidKonekt platform terms.
6. Personal Information and POPIA

Mpepu Nnaka Day Care processes personal information in accordance with the Protection of Personal Information Act 4 of 2013 (“POPIA”) and other applicable South African laws.

Personal information may include information relating to the child, parent/guardian, emergency contacts, attendance, payments, communications, and other information reasonably required to provide daycare services.

Mpepu Nnaka Day Care is responsible for determining why and how personal information is processed.
-
KidKonekt acts as a service provider/operator providing the technology used by the daycare.
-
Personal information will not knowingly be sold to third parties.
-
Parents/guardians may request access to or correction of personal information, subject to applicable legal requirements.

7. Photos, Videos and Media

Mpepu Nnaka Day Care may take photographs or videos of children during daycare activities for legitimate daycare and communication purposes.

Where specific consent is required, the daycare will obtain the appropriate consent from the parent or legal guardian.

Media shared through KidKonekt may be made available only to authorised parents/guardians or users, subject to the platform’s access controls.
-
Parents/guardians must not copy, distribute, publish, or share photographs, videos, or personal information relating to other children without appropriate permission.
8. Health, Illness and Medication

Parents/guardians must provide accurate information about relevant medical conditions, allergies, medication, and other health-related matters that may affect the child’s wellbeing.

Parents/guardians must notify the daycare if the child has an infectious illness or condition that may affect other children or staff.
-
A child who is unwell may be required to remain at home until it is reasonably safe for the child to return, in accordance with the daycare’s health and safety procedures.

Medication will only be administered where appropriate authorisation and instructions have been provided and where the daycare is reasonably able to administer it safely.

In an emergency, Mpepu Nnaka Day Care may take reasonable steps to obtain urgent medical assistance for a child and contact the parent/guardian or emergency contact.
9. Child Safety and Supervision
Mpepu Nnaka Day Care will take reasonable measures to provide a safe and appropriate environment for children in its care.
Parents/guardians acknowledge that normal daycare activities may involve ordinary risks associated with play, movement, outdoor activities, and interaction with other children.
The daycare will take reasonable precautions to minimise foreseeable risks and respond appropriately to accidents, injuries, emergencies, or safety concerns.
10. Behaviour and Discipline

Children are expected to behave in a manner that promotes a safe and respectful environment.

Mpepu Nnaka Day Care will use reasonable and appropriate behaviour-management practices.

Physical punishment, humiliation, or abusive disciplinary practices will not be permitted.

Where persistent behavioural or safety concerns arise, the daycare may meet with the parent/guardian to agree on an appropriate course of action.
11. Damage to Property
Parents/guardians may be held responsible for deliberate or negligent damage caused by their child to daycare property, equipment, or facilities, subject to the circumstances and applicable law.
12. Communication

Mpepu Nnaka Day Care may communicate with parents/guardians through KidKonekt, email, telephone, SMS, WhatsApp, or other approved communication channels.

Parents/guardians are responsible for ensuring that their contact details remain up to date.

Important notices, invoices, announcements, and other communications may be delivered electronically.
13. Suspension or Termination of Services
Mpepu Nnaka Day Care may suspend or terminate a child’s enrolment where reasonably necessary, including in circumstances involving:

Persistent non-payment of fees;
-
Serious or repeated breaches of daycare rules;
-
Conduct that creates a significant safety risk;
-
Provision of materially false or misleading information;
-
Circumstances where the daycare can no longer reasonably provide appropriate care.
Where reasonably possible, parents/guardians will be given notice before termination or suspension.
Parents/guardians wishing to terminate enrolment must provide notice in accordance with the daycare’s applicable cancellation or withdrawal policy.
14. Limitation of Liability
Mpepu Nnaka Day Care will take reasonable measures to protect children and their personal belongings while they are attending the daycare.
To the extent permitted by South African law, the daycare will not be responsible for loss or damage arising from circumstances outside its reasonable control.
Nothing in these Terms and Conditions excludes or limits any liability that cannot lawfully be excluded or limited under applicable law.
15. Third-Party Services
Mpepu Nnaka Day Care may use third-party service providers to support its operations, including technology, payment processing, communication, hosting, and other administrative services.
Where third-party services process personal information on behalf of the daycare, the daycare will take reasonable steps to ensure that such processing is carried out in accordance with applicable privacy and data-protection requirements.
16. Changes to These Terms
Mpepu Nnaka Day Care may update these Terms and Conditions from time to time to reflect changes in its services, operations, technology, or legal requirements.
The latest version will be made available to parents/guardians through an appropriate communication channel or on the daycare’s website.
17. Governing Law
These Terms and Conditions are governed by the laws of the Republic of South Africa.
Any dispute relating to these Terms and Conditions will, where possible, first be addressed directly between the parent/guardian and Mpepu Nnaka Day Care before formal legal proceedings are considered.
